This Privacy Statement and Notice of Privacy Practices (“Privacy Policy”) sets forth the privacy practices of Unmasked, Inc., (collectively, “Company” “Us” “We” or “Unmasked”). Unmasked respects your privacy and is committed to protecting it through compliance with this Privacy Policy. This Privacy Policy describes how your personal information is collected, used, maintained, protected, and shared when you use the Website (the “Website”), our Mobile Application (“App”) or otherwise utilize our service offerings.

We may change this Privacy Policy from time to time. If We do, We will post the updated Privacy Policy with the last revised date on the Website and on the App. If We make material changes to the Privacy Policy, then We will provide a revised version to you and/or your email address seeking your affirmative consent to the revised terms, if we are required to do so by law.

1. WHAT INFORMATION DO WE COLLECT?

Personal information you disclose to us

In short:  We collect information that you provide when you create an account and your subsequent interactions with the App through that account.

We collect personal information that you voluntarily provide to us when you register on the App, express an interest in obtaining information about us or our products and services, when you participate in activities on the App (such as by posting messages in our online forums or entering competitions, contests or giveaways) or otherwise when you contact us.

The personal information that we collect depends on the context of your interactions with us and the App, the choices you make and the products and features you use. The personal information we collect may include the following:

  • Personal information provided by you. We collect email addresses, passwords, and other similar information.

All personal information that you provide to us must be true, complete and accurate, and you must notify us of any changes to such personal information.

Information automatically collected through our App

In short:  Some information — such as your Internet Protocol (IP) address and/or browser and device characteristics — is collected automatically when you visit our App.

We automatically collect certain information when you visit, use or navigate the App. This information does not reveal your specific identity (like your name or contact information) but may include device and usage information, such as your IP address, browser and device characteristics, operating system, language preferences, referring URLs, device name, country, information about who and when you use our App and other technical information. This information is needed to maintain the security and operation of our App, and for our internal analytics and reporting purposes. 

The information we collect includes:

  • Log and Usage Data. Log and usage data is service-related, diagnostic usage and performance information our servers automatically collect when you access or use our App and which we record in log files. Depending on how you interact with us, this log data may include your IP address, device information, browser type and settings and information about your activity in the App (such as the date/time stamps associated with your usage, pages and files viewed, searches and other actions you take such as which features you use), device event information (such as system activity, error reports (sometimes called 'crash dumps') and hardware settings).

  • Device Data. We collect device data such as information about your computer, phone, tablet or other device you use to access the App. Depending on the device used, this device data may include information such as your IP address (or proxy server), device application identification numbers, location, browser type, hardware model, Internet  service provider and/or mobile carrier, or operating system configuration information.

All personal information that you provide to us must be true, complete and accurate, and you must notify us of any changes to such personal information.

2. HOW DO WE USE YOUR INFORMATION?

In short:  We process your information for purposes based on legitimate business interests, the fulfillment of our contract with you, compliance with our legal obligations 

We use personal information collected via our App for a variety of business purposes described below. 

We process your personal information for these purposes in reliance on our legitimate business interests, in order to enter into or perform a contract with you, with your consent, and/or for compliance with our legal obligations. We indicate the specific processing grounds we rely on next to each purpose listed below.

We use the information we collect or receive:

  • To facilitate account creation and logon process. 

  • To request feedback. We may use your information to request feedback and to contact you about your use of our App.

  • To manage user accounts. We may use your information for the purposes of managing your account and keeping it in working order.

  • To send administrative information to you. We may use your personal information to send you product, service and new feature information and/or information about changes to our terms, conditions, and policies.

  • To protect our Services. We may use your information as part of our efforts to keep our App safe and secure (for example, for fraud monitoring and prevention).

  • To enforce our terms, conditions and policies for business purposes, to comply with legal and regulatory requirements or in connection with our contract.

  • To respond to legal requests and prevent harm. If we receive a subpoena or other legal request, we may need to inspect the data we hold to determine how to respond.

For other business purposes: We may use your information for other business purposes, such as data analysis, identifying usage trends, and to evaluate and improve our App, products, marketing and your experience. We may use and store this information in aggregated and anonymized form so that it is not associated with individual users and does not include personal information. We will not use identifiable personal information without your consent.

We may also collect other personal information outside of these categories in instances where you interact with us in-person, online, or by phone or mail in the context of:

  • Receiving help through our customer support channels

  • Participation in customer surveys or contests; and

  • Facilitation in the delivery of our Services and to respond to your inquiries

3. WILL YOUR INFORMATION BE SHARED WITH ANYONE?

In short:  We only share information with your consent, to comply with laws, to provide you with services, to protect your rights, or to fulfill business obligations.

We may process or share your data that we hold based on the following legal basis:

  • Legitimate Interests: We may process your data when it is reasonably necessary to achieve our legitimate business interests.

  • Performance of a Contract: Where we have entered into a contract with you, we may process your personal information to fulfill the terms of our contract.

  • Legal Obligations: We may disclose your information where we are legally required to do so in order to comply with applicable law or legal process, such as in response to a court order or a subpoena (including in response to public authorities to meet national security or law enforcement requirements).

  • Vital Interests: We may disclose your information where we believe it is necessary to investigate, prevent, or take action regarding potential violations of our policies, suspected fraud, situations involving imminent threats to the safety of any person and illegal activities, or as evidence in litigation in which we are involved.

More specifically, we may need to process your data or share your personal information in the following situations:

  • Business Transfers. We may share or transfer your information in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company.

  • Vendors, Consultants and Other Third-Party Service Providers. We may share your data with third-party vendors, service providers, contractors or agents who perform services for us or on our behalf and require access to such information to do that work. Examples include: payment processing, data analysis, email delivery, hosting services, customer service and marketing efforts. We may allow selected third parties to use tracking technology on the App, which will enable them to collect data on our behalf about how you interact with our App over time. This information may be used to, among other things, analyze and track data, determine the popularity of certain content, pages or features, and better understand online activity. Unless described in this notice, we do not share, sell, rent or trade any of your information with third parties for their promotional purposes. 

4. WHO WILL YOUR INFORMATION BE SHARED WITH?

In short:  We only share information with the following third parties.

5. IS YOUR INFORMATION TRANSFERRED INTERNATIONALLY?

In short:  We may transfer, store, and process your information in countries other than your own.

Our servers are located in the US. If you are accessing our App from outside, please be aware that your information may be transferred to, stored, and processed by us in our facilities and by those third parties with whom we may share your personal information (see "3. WILL YOUR INFORMATION BE SHARED WITH ANYONE?" above), in and other countries.

If you are a resident in the European Economic Area, then these countries may not necessarily have data protection laws or other similar laws as comprehensive as those in your country. We will however take all necessary measures to protect your personal information in accordance with this privacy notice and applicable law.

6. HOW LONG DO WE KEEP YOUR INFORMATION?

In short:  We keep your information for as long as necessary to fulfill the purposes outlined in this privacy notice unless otherwise required by law.

We will only keep your personal information for as long as it is necessary for the purposes set out in this privacy notice, unless a longer retention period is required or permitted by law (such as tax, accounting or other legal requirements). When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize such information, or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.

7. HOW DO WE KEEP YOUR INFORMATION SAFE?

In short:  We aim to protect your personal information through a system of organizational and technical security measures. 

We have implemented appropriate technical and organizational security measures designed to protect the security of any personal information we process. Yet, despite our safeguards and best efforts to secure your information, no electronic transmission over the Internet or information storage technology can be guaranteed to be 100% secure. We cannot promise or guarantee that unauthorized third parties will not improperly collect, access, steal, or modify your information. Although we will do our best to protect your personal information, transmission of personal information to and from our App is at your own risk. You should only access the App within a secure environment.

8. WHAT ARE YOUR PRIVACY RIGHTS?

In short:  In California, you have additional rights that allow you greater access to and control over your personal information. However, here at Unmasked we are dedicated to maintaining the utmost transparency so each and every one of our users may request and obtain free of charge information about what personal information we collect and disclose to third parties for analytical purposes. 

Every Unmasked User has the ability to: (i) to request access and obtain a copy of your personal information, (ii) to request rectification or erasure; (iii) to restrict the processing of your personal information; and (iv) if applicable, to data portability.

In certain circumstances, you may also have the right to object to the processing of your personal information. To make such a request, please use the contact details provided below. 

If we are relying on your consent to process your personal information, you have the right to withdraw your consent at any time. Please note however that this will not affect the lawfulness of the processing before its withdrawal, nor will it affect the processing of your personal information conducted in reliance on lawful processing grounds other than consent.

Account Information

If you would at any time like to review or change the information in your account or terminate your account, you can:

    ■  Log in to your account settings and update your user account.

Upon your request to terminate your account, we will deactivate or delete your account and information from our active databases. However, we may retain some information in our files to prevent fraud, troubleshoot problems, assist with any investigations, enforce our Terms of Service and/or comply with applicable legal requirements.

Opting out of email marketing: You can unsubscribe from our marketing email list at any time by clicking on the unsubscribe link in the emails that we send or by contacting us using the details provided below. You will then be removed from the marketing email list – however, we may still communicate with you, for example to send you service-related emails that are necessary for the administration and use of your account, to respond to service requests, or for other non-marketing purposes. To otherwise opt-out, you may:

9. CONTROLS FOR DO-NOT-TRACK FEATURES

Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track (“DNT”) feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. At this stage, no uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this privacy notice.

10. DO CALIFORNIA RESIDENTS HAVE SPECIFIC PRIVACY RIGHTS?

In short:  Yes, if you are a resident of California, you are granted specific rights regarding access to your personal information. Any user may submit a request to determine what categories of personal information we collect and disclose to third parties for analytical purposes.

California Civil Code Section 1798.83, also known as the “Shine The Light” law, permits our users who are California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year. If you are a California resident and would like to make such a request, please submit your request in writing to us using the contact information provided below.

If you are under 18 years of age, reside in California, and have a registered account with the App, you have the right to request removal of unwanted data that you publicly post on the App. To request removal of such data, please contact us using the contact information provided below, and include the email address associated with your account and a statement that you reside in California. We will make sure the data is not publicly displayed on the App, but please be aware that the data may not be completely or comprehensively removed from all our systems (e.g. backups, etc.).  

The California Consumer Privacy Act of 2018 (CCPA) provides California consumers (California residents) with specific rights regarding their personal information. This section describes those rights and explains how to exercise them.

As a California resident, you have the right under the CCPA to exercise free of charge:

a. Disclosure of Personal Information We Collect About You

You have the right to know:

i. The categories of personal information we have collected about you;

ii. The categories of sources from which the personal information is collected;

iii. Our business or commercial purpose for collecting or selling personal information;

iv. The categories of third parties with whom we share personal information, if any;

v. The specific pieces of personal information we have collected about you;

Please note that we are not required to:

i. Retain any personal information about you that was collected for a single one-time transaction if, in the ordinary course of business, that information about you is not retained;

ii. Reidentify or otherwise link any data that, in the ordinary course of business, is not maintained in a manner that would be considered personal information; or

iii. Provide the personal information to you more than twice in a 12-month period.

b. Disclosure of Personal Information Sold or Used for a Business Purpose

In connection with any personal information we may sell or disclose to a third party for a business purpose, you have the right to know:

i. The categories of personal information about you that we sold and the categories of third parties to whom the personal information was sold; and

ii. The categories of personal information that we disclosed about you for a business purpose.

c. Right to Opt-Out of the Sale of Personal Information

Under the CCPA, you have the right to opt-out of the sale of your personal information. Please be aware that Unmasked is not currently in the business of selling personal information; however, if you exercise your right to opt-out of the sale of your personal information, we will add you to a “Do Not Sell List.”

 

d. Right to Deletion

You have the right to request that we delete any of your personal information that we collected from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable consumer request, we will delete (and direct our service providers to delete) your personal information from our records, unless an exception applies.

Please note that we may not delete your personal information if it is necessary to:

i. Complete the transaction for which the personal information was collected, provide a good or service requested by you or reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform services under a contract;

ii. Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for that activity;

iii. Debug to identify and repair errors that impair existing intended functionality;

iv. Exercise free speech, ensure the right of another consumer to exercise his or her right of free speech, or exercise another right provided for by law;

v. Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et seq.);

vi. Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when our deletion of the information is likely to render impossible or seriously impair the achievement of such research, provided we have obtained your informed consent;

vii. Enable solely internal uses that are reasonably aligned with your expectations based on your relationship with us;

viii. Comply with an existing legal or contractual obligation; or

ix. Otherwise use your personal information, internally, in a lawful manner that is compatible with the context in which you provided the information.

e. Protection Against Discrimination

You have the right to not be discriminated against by us because you exercise any of your rights under the CCPA. This means we cannot, among other things:

i. Deny goods or services to you;

ii. Charge different prices or rates for goods or services, including through the use of discounts or other benefits or imposing penalties;

iii. Provide a different level or quality of goods or services to you; or

iv. Suggest that you will receive a different price or rate for goods or services or a different level or quality of goods or services.

Please note that we may charge a different price or rate or provide a different level or quality of goods and/or services to you if that difference is reasonably related to the value provided to you by your personal information.

Submitting Requests

Requests to Know, Requests to Delete and Do-Not-Sell (Opt-out) Requests* may be submitted by calling us at (404) 519-8990.

*Please note that Unmasked is not in the business of selling Personal Information.

Only you, or a person registered with the California Secretary of State that you authorize to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child.

You may only make a verifiable consumer request for access or data portability twice within a 12-month period. The verifiable consumer request must:

  • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative; and

  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you. Making a verifiable consumer request does not require you to create an account with us. We will only use personal information provided in a verifiable consumer request to verify your identity or authority to make the request.

Response Timing and Format:

We endeavor to respond to a verifiable consumer request within 45 days of its receipt. If we require more time (up to 90 days), we will inform you of the reason and extension period in writing. Any disclosures we provide will only cover the 12-month period preceding the verifiable consumer request's receipt. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

Collection of Personal Information:

We collect information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household (“personal information”).

Categories of Personal Information Collected:

In particular, we have collected the following categories of personal information from consumers within the last twelve (12) months:

A. Identifiers.

Examples: A real name, alias, postal address, unique personal identifier, online identifier, Internet Protocol address, email address, account name, Social Security number, driver's license number, passport number, or other similar identifiers.

B. Personal information categories listed in the California Customer Records statute (Cal. Civ. Code § 1798.80(e)).

Examples: A name, signature, Social Security number, physical characteristics or description, address, telephone number, passport number, driver's license or state identification card number, insurance policy number, education, employment, employment history, bank account number, credit card number, debit card number, or any other financial information, medical information, or health insurance information. Some personal information included in this category may overlap with other categories.

C. Commercial information.

Examples: Records of personal property, products or services purchased, obtained, or considered, or other purchasing or consuming histories or tendencies.

D. Internet or other similar network activity.

Examples: Browsing history, search history, information on a consumer's interaction with a website, application, or advertisement.


This Section on the rights of California residents does not address or apply to Unmasked’s handling of:

  • Publicly available information from government records;

  • De-identified or aggregated consumer information;

  • Health or medical information covered by the Health Insurance Portability and Accountability Act of 1996 (HIPAA) and the California Confidentiality of Medical Information Act (CMIA) or clinical trial data;

  • Personal information covered by certain sector-specific privacy laws, including the Fair Credit Reporting Act (FCRA), the Gramm-Leach-Bliley Act (GLBA) or California Financial Information Privacy Act (FIPA), and the Driver's Privacy Protection Act of 1994;

  • Personal information we collect about job applicants, independent contractors, or current or former full-time, part-time and temporary employees and staff, officers, directors or owners of Unmasked; and

  • Personal information about individuals acting for or on behalf of another company, to the extent the information relates to our transactions with such company, products or services that we receive from or provide to such company, or associated communications or transactions (accept that such individuals have the right to opt-out of any sale of their personal information and to not be subject to any discrimination for exercising such right).

Sources of Information Collected:

We collect personal information directly from you, as well as automatically related to your use of our websites, our application and other services, and from third parties. For example, we collect personal information:

  • From any form you may complete and submit through our websites or applications, for example information collected from the "Contact Us" page of our websites or applications;

  • From the content of surveys that you may complete;

  • From 'cookies' and other similar tools deployed on parts of our websites or applications that can only be accessed by authenticated users who are logged into the website

  • When you provide information as a client in connection with us providing professional services to you;

  • From other sources, such as public databases, joint marketing partners, social media platforms (including from people with whom you are friends or otherwise connected) and from other third parties; and

  • From or on behalf of clients when we provide professional services, which could include personal information about their employees, benefits recipients, insureds, etc.

Purposes of Collecting Information:

Our collection, use and disclosure of personal information about a California resident will vary depending upon the circumstances and nature of our interactions or relationship with such resident. The table above sets out generally the categories of personal information (as defined by the CCPA) about California residents that we collect and disclose to others for a business purpose. We collect these categories of personal information from the sources described in the Sources of Information Collected section above, and for the following purposes:

  • Contract administration;

  • Executing and performing our client engagements;

  • Providing various professional services to our clients;

  • Activating and maintaining client accounts;

  • Fulfilling requests for or responding to inquiries about our products or services;

  • Analyzing how our websites are used and how they are performing;

  • Performing business development analysis; 

  • Providing offers and information to you (as permitted by law) about products, services, or events offered by us or that we think may be of interest to you; and

We will not collect additional categories of personal information or use the personal information we collected for materially different, unrelated, or incompatible purposes without providing you notice.

Sharing Personal Information:

We may disclose your personal information to a third party for a business purpose. When we disclose personal information for a business purpose, we enter into a contract that describes the purpose and requires the recipient to both keep that personal information confidential and not use it for any purpose except performing the contract.

We disclosed your personal information for a business purpose to the following categories of third parties:

  • Unmasked affiliates;

  • Service providers and independent contractors we use to help deliver our products and/or services;
